By entering and taking part in the Rock a Rail Competition at SnowFest Innsbruck (as Competition) organized by Snowfest Wintersport Aktivierung (as SNF) and Austrian Snowboard Association (as ASA) I, the Participant, confirm that I understand and accept that:
1. There are certain risks and dangers inherent in taking part in the Competition and that, by the very nature of the skiing involved in the Competition, I will be exposed to an element of personal risk over and above those associated with conventional snowboarding activities. This includes the risk of personal injury and death to myself and loss of or damage to my property. I also expressly understand that I am under a duty to mitigate any risks to myself as far as is practicable, by taking all reasonable steps to ensure my own safety whilst participating in the Competition. Except as stated in paragraph 8, I accept full responsibility for these risks and I agree that SNF and ASA, its employees, agents and subcontractors are released from any liability resulting from my injury or death or any loss of or damage to my property suffered during the Competition.
2. I am willingly and voluntarily entering the Competition in full knowledge of the risks and dangers inherent in taking part in the Competition.
3. I am adequately fit and physically capable of taking part in the Competition and have no medical or other condition which would in any way affect my participation in the Competition.
4. Any information that I have provided to SNF and ASA about my skiing experience and ability is true and accurate and I confirm that I am competent enough to take part in competitive skiing generally and, in particular, to engage in the type of skiing that will be involved in the Competition.
5. I am required to and I shall follow all instructions provided to me by the organizers of the Competition, or any other person in authority, including but not limited to in relation to my participation in the Competition and any routes to be followed or avoided in the area in which the Competition will take place. I understand that if I fail to comply with these instructions, SNF and ASA or any other person in authority during the course of the Competition, reserves the right to suspend my participation in the Competition.
6. I am at all times solely responsible for my possessions, including my skiing equipment. SNF and ASA accepts no liability for any damage to or loss of my property whilst taking part in the Competition (except where such loss or damage arose as a result of RAR, SNF and ASA´s negligence).
7. I have provided emergency contact details to SNF and ASA and authorize them to contact that person(s) in the event of an emergency.
8. I confirm that as a minimum I have at least medical, personal liability and personal accident insurance policies in place with a reputable insurer. I acknowledge that SNF and ASA will not be checking my insurance policies and it is my sole responsibility to make sure that they are sufficient.
9. SNF and ASA does not exclude or limit its liability for any liability which cannot be excluded or limited under applicable law including liability for fraud or misrepresentation or for any death or personal injury which is caused by SNF and ASA´s negligence.
10. That this agreement will be interpreted according to the law of the Austrian state.
11. That any disputes relating to the enforcement of this agreement before the court of the Austrian state be submitted and that they will not be transferred to another state.
12. By taking part in the Competition and signing this Acknowledgement of Responsibility and Risk Form I hereby freely agree to allow SNF and ASA and its sponsors the right to use, in perpetuity, any and all likenesses, images, audio recordings and video recordings of me taken during my participation in the Competition, for marketing and advertising purposes, in all media, worldwide and in perpetuity.
13. SNF and ASA will be enabled to use, broadcast, screen, display, reproduce and/or make available to the public the Material in any and all media, including but not limited to radio, television, cinemas, events, data carriers and the worldwide web. SNF and ASA will be entitled to make any alterations, intermissions, cuts or other modifications in and to the Material and to use such altered Material without restrictions. Furthermore, SNF and ASA is allowed to transfer the granted rights to any third party. I know that I won’t have the right to approve any of the Material. I understand that I might not be named as a participant in Snowfest – RAR and do not expect to gain financially from my appearance in any Snowfest – RAR related Material.
14. f not stated otherwise SNF and ASA allows me to use my own camera (or bring a photographer/filmer) at the event in order to record moving images and/or a series of still images/shoot content (“Participant Content”). The use of such Participant Content is limited to private purposes meaning on my own website and my social media channels. I understand that SNF and ASA holds the intellectual property and media rights in the event and upon request I will provide SNF and ASA access to the Participant Content. Any commercial use either by myself or third parties is subject to SNF and ASA prior consent.
SNF and ASA or third parties, as it may authorize from time to time, will be entitled to collect technical performance data (e.g. speed, stance, airtime, rotations, G-forces and positioning data) and to use such data as defined above, unless the collection of such technical performance data could affect the sporting result.

I, the undersigned participant, have read and understand the terms of this Agreement, and I voluntarily and of my own free will sign this Agreement. I acknowledge that this Agreement is binding on me, my heirs, assigns and relatives.
